Why getting married in Spain?

I want to get married in Spain, but I don’t know where to start…. help!?

Getting married in Spain can seem initially daunting, due to the extensive legalities associated with it. But don’t worry, all is simpler than it seems.

A civil or religious marriage can only be carried out in Spain for those who meet the legal and residency requirements. To have a legally contracted marriage in Spain, at least one party to the marriage must be a resident of Spain for at least 2 years.

For this reason, most couples availing of a destination wedding in Spain, will opt to get legally and contractually married in their home country. They will then conduct a wedding ceremony that is wholly symbolic in Spain.

What legalities are associated with getting married in Spain?

There are two types of marriage in Spain. Civil marriage and religious marriage. A civil marriage is a legally contracted marriage without a religious element. Civil marriages can take place at a district court, civil registry office or local town hall.

Religious marriage in Spain (Protestant, Jewish, Muslim, Catholic) can be carried out without having a civil marriage beforehand. After the religious wedding ceremony, the marriage must be performed by a licensed marriage official and registered with the civil authorities.

The legal requirements for registering your marriage in Spain depend on several factors. To qualify for legal marriage in Spain:

 

    • Both parties to the marriage must be over the age of 18.
    • At least 1 party must be a Spanish Citizen or resident of Spain for at least 2 years – proof of this must be established by presenting a certificate of residency.
  • Proof must be established that the couple are legally allowed to get married. (Certificate of no Impediment.) 
  • All necessary paperwork and documentation must be sourced and presented. E.g., long form birth certificate notarised and translated into Spanish, divorce degrees where applicable etc.

 

For these reasons, most couples availing of a destination wedding in Spain, will get legally and contractually married in their home country, and will conduct a wedding ceremony that is uniquely symbolic in Spain. Same sex marriage was legalised in Spain in 2005. This guarantees identical rights to all married couples regardless of sexual orientation.
